1043 Quixote Ave N - Public Hearing

Notice is hereby given that the Lakeland City Council will be holding a public hearing on the following items on May 21, 2024, starting at 6:00 p.m. at the City Hall located at 690 Quinnell Ave N, Lakeland, MN 55043.

 

PUBLIC HEARING CONDITIONAL USE PERMIT: The applicant has requested a conditional use permit to raise an existing dwelling out of the floodplain using a method other than fill, as required by Section 154.27(D) of the City Code. Submitted by Shane Webber (on behalf of Jenica and Gregg Jones, owners), located at 1043 Quixote Ave N, Lakeland, MN 55043 (PID: 26.029.20.43.0009). SCRD (St. Croix River District) zoned district, R-1 underlying district.

An Ordinance Amending and Updating the Lakeland City Code

ORDINANCE 2024-05

 An Ordinance Amending and Updating the Lakeland City Code

Chapter 91 to Provide for Adoption of the State Fire Code, Including Inspection of Commercial Buildings

THE CITY COUNCIL OF THE CITY OF LAKELAND, WASHINGTON COUNTY, MINNESOTA, DOES HEREBY ORDAIN AS FOLLOWS:

The Minnesota State Fire Code, as adopted pursuant to Minnesota Statutes, section 299F.011, and as modified by Minnesota Rules, Chapter 7511, is hereby adopted within the City of Lakeland, MN.

Section 1. DEFINITIONS.

(a) Wherever the word 'jurisdiction" is used in the Minnesota State Fire Code, it shall mean the City of Lakeland, MN.

(b) Whenever the term 'this code" is used in the Minnesota State Fire Code or this ordinance, it shall mean the code adopted pursuant to this ordinance.

Section 2. ENFORCEMENT.

a. The Minnesota State Fire Code shall be enforced by the Fire Chief of the Lower St. Croix Valley Fire Department.

b. The Fire Marshal shall be appointed by the Fire Chief.

  1. Whenever the term State Fire Marshal or Fire Chief appear in the Minnesota State Fire Code, it shall include the Fire Marshal of the Lower St. Croix Valley Fire Department.
  2. The Chief of the Lower St. Croix Valley Fire Department may detail members of the department as Fire Inspectors.
  3. Fire Inspectors are responsible for the examination of non-residential buildings to detect fire hazards and ensure that all federal, state, and local fire codes are met, and also may be responsible for plan review as directed.
  4. Fire Marshal and/or Fire Inspectors are responsible for the examination of the non-residential buildings to detect fire hazards and ensure that all federal, state, and local fire codes are met.  Additional duties include fire code enforcement, and/or investigation of fire cause and origin.  They are also responsible for approval of work permits, and building plan review to assure that all new and existing non-residential construction meets all federal, state, and local building codes.

g. The Chief of the fire department (the Lower St. Croix Valley Fire Protection District), Fire Marshal or Building Official is authorized to enforce the provisions of the Minnesota State Fire Code and this ordinance.

h. The Chief of the fire department, Fire Marshal or Building Official may detail such members of the fire department as may be necessary to administer and enforce the provisions of this ordinance.

Section 3. AMENDMENTS TO THE MINNESOTA STATE FIRE CODE

Pursuant to Minnesota Statutes § 299F.011, and Minnesota Rule 7510.3510, The Minnesota State Fire Code (MSFC), current adopted version, and all amendments, including Appendices A, B, C, D, E, I, O and P thereto, one copy of which has been marked as the official copy and which is on file in the office of the City Clerk, is hereby adopted as the Fire Code for the City of Lakeland for the purpose of prescribing regulations governing conditions of hazardous to life and property from fire or explosion.  Every provision contained in this Code, except as modified or amended by this subchapter, is hereby adopted and made part of this subchapter as if fully set forth herein.  The scope of these regulations is intended to consistent with Minnesota Statutes, § 299F.011.

Subject to any amendments made by the city, the 2020 Minnesota State Fire Code (MSFC) including Appendices A, B, C, D, E, F, G, H and J is adopted by reference as the city fire code. Such code adopts by reference the International Fire Code (IFC) promulgated by the International Conference of Building Officials and Minnesota Fire Chiefs Association. One copy of the MSFC and the IFC will be retained on file in the city administrator's office.

Section 4. FIRE PREVENTION INSPECTIONS

The Fire Marshal, Fire Inspector, Fire Chief or his/her designee is authorized to enter and examine any commercial building in accordance with MSFC Section 104.3 Right of entry, for the purpose of enforcing this code and such entry shall be permitted.

Section 5. PERMITS & FEES

(A)   A permit from the Fire Prevention Bureau is required to conduct the following:

  • Operational permit -
  • Fire inspection -
  • Burn permits -
  • sprinkler head -
  • Investigation/ violation fee:

  (1)   Install any automatic fire sprinkler system;

      (2)   Install any automatic fire suppression or extinguishing system;

      (3)   Modify an automatic sprinkler, fire suppression system or fire extinguishing system;

      (4)   Install any aboveground or underground liquid fuel storage tank;

      (5)   Install any aboveground or underground liquefied gas storage tank;

      (6)   Install or modify any fire alarm detection or signaling system when the value of the installation or modification exceeds $1,000;

      (7)   Remove an underground liquid fuel storage tank;

      (8)   Clean and degrease commercial hoods and ducts; and

      (9)   Temporary tent / canopy.

Section 6. PENALTIES.

A person who violates the provisions of the Minnesota State Fire Code or this ordinance after being given written notice shall be guilty of a misdemeanor. Each day’s violation after notice thereof shall constitute a separate offense.

In addition, eligibility to renew a liquor license in the City of Lakeland and Lower Lakeland is contingent on code violation correction. Outstanding Building & Fire code violations disqualify an applicant to receive a liquor license until such time as all code violations have been corrected.

Section 7. EFFECTIVE DATE.

This ordinance takes effect upon its adoption and publication according to law.

 Whereupon said Ordinance was declared passed and adopted this 16th day of January 2024.
